Complete Acquittal Secured in High-Stakes Aggravated Child Rape Trial in Worcester County

After a multi-day trial involving a number of civilian witnesses and medical testimony from the Commonwealth's proffered child sex assault examiner, the jury deliberated for just-short-of three hours before returning a complete acquittal on every count. For our client, the jury's verdicts were the difference between him spending at least 15 years, and up-to the rest of his life in state prison and walking out of the courthouse a free man. A Life on the Line in Worcester County

From the first pretrial conference to the final moments of closing argument, there was never any doubt about the stakes. The charges carried the possibility of life imprisonment. The allegations were deeply emotional and the atmosphere in the courtroom reflected the gravity of what had been accused. In that setting, the presumption of innocence can be fragile unless it is actively defended. The Commonwealth brought all of its resources to bear and asked the jury to condemn our client based on allegations alone. Second Complete Acquittal in Aggravated Child Rape Trials in Just Over 12 Months

This result did not happen in isolation. It comes on the heels of another aggravated child rape trial in Massachusetts Superior Court in which Attorneys Garrity and Reilly also obtained straight not guilty verdicts for a client facing a mandatory state prison sentence in a case that also involved aggravated child rape charges, as well as additional counts of forcible child rape and indecent assault and batter over, and under 14, charges. In a matter of just over twelve months, Dan and Pat have twice taken on some of the most serious and stigmatizing charges in the criminal code, tried them to a jury, and walked their clients out of the courthouse free of all charges.
