Brad Bailey Quoted by Rolling Stone in Coverage of Sean “Diddy” Combs Trial

Founding attorney Brad Bailey was recently quoted by Rolling Stone in its coverage of the ongoing federal trial of Sean “Diddy” Combs.

A nationally recognized criminal defense lawyer and former federal and state prosecutor, Mr. Bailey provided insight into the prosecution’s and defense’s tactical decisions regarding Kristina Khorram, Combs’ former chief of staff.

Brad Bailey’s Analysis Featured in Rolling Stone

In the article, Rolling Stone explored why neither the prosecution nor the defense called Khorram – described by some as Combs’ “most loyal lieutenant” – to testify in the federal trial. Both sides have repeatedly referenced Khorram’s actions and communications, and evidence seized from her devices has been central to the government’s case. Yet, her absence from the witness stand has fueled speculation about the underlying legal strategy.

Attorney Brad Bailey, drawing on his background as both a former federal and state prosecutor and a leading defense attorney, offered this insight:

“I can only surmise the prosecution may have felt she might provide exculpatory testimony benefitting the defense, and the defense may have felt that what she allegedly saw or did as his assistant might be potentially useful to the prosecution. That’s usually the reason a theoretically percipient witness is not called by either side.”

Mr. Bailey’s perspective underscores the nuanced, high-stakes decision-making involved in complex criminal trials, particularly when both sides must weigh the risks of putting certain witnesses on the stand. His commentary reflects the type of sophisticated legal analysis that has made him a sought-after authority not only in the courtroom but also in the national media.

This type of strategic decision-making ultimately proved significant as the trial concluded. As reported by the Associated Press on Wednesday, July 2, Combs was convicted of prostitution-related offenses but acquitted of sex trafficking and racketeering charges that could have resulted in life imprisonment – an outcome shaped in part by the complex choices both sides made about evidence and witnesses.
