Leaving the Scene

"Whoever upon any way or in any place to which the public has a right of access, or any place to which members of the public have access as invitees or licensees without stopping and making known his name, residence and the [registration] number of his motor vehicle goes away after knowingly colliding with or otherwise causing injury to any other vehicle or property shall be punished." In order to prove the defendant guilty of this offense, the Commonwealth must prove five things beyond a reasonable doubt:

  1. That the defendant operated a motor vehicle
  2. That a defendant operated it in a place of public access.
  3. That while a defendant was operating the vehicle, they collided with, or caused damage in some other way, to another vehicle or property.
  4. That a defendant knew that they caused the damage
  5. That after such collision or injury, the defendant did not stop and make known their name, home address, and the registration number of their motor vehicle.
